Five Types Of Benefits For Injured Workers

Workers’ compensation is designed to help injured workers get back on their feet. If you’ve suffered a job-related injury or illness, you may be entitled to multiple benefits. These benefits will drastically cushion the financial impact of an injury.

  1. Wages. If you can’t work due to an injury, you may be entitled to weekly benefits to partially replace your lost wages. The amount you receive depends on your earning capacity at the time of your injury. Calculating your earning capacity can be complex, especially if your wages have fluctuated. We can assess your situation to maximize the benefits you receive.
  2. Medical benefits. You shouldn’t have to pay for medical expenses related to an on-the-job injury. Your employer’s insurance company has 100 percent financial responsibility for treatment related to the covered injury. This means you won’t have to pay a penny in copays, deductibles, office visits, medications or other treatments. You are also entitled to mileage reimbursement for medical visits.
  3. Reinstatement. If you can’t work due to an injury, federal law requires most employers to hold your position for 12 weeks. New Hampshire law provides much stronger protection. Your employer must hold your job for a year and a half, allowing you time to recuperate from a work-related injury or illness.
  4. Vocational rehabilitation. What if your injury prevents you from ever returning to the same job? In these situations, your employer’s insurance company may be required to help you find another job — one with the same earning capacity. You may also be entitled to job coaching, retraining or licensing assistance.
  5. Permanent impairment award. Some injuries have a lifelong impact. Because workers’ compensation doesn’t provide compensation for pain and suffering, it instead offers a separate cash award for those left permanently impaired by a work-related injury. The formula for calculating this award takes into account your weekly wage benefits (highlighting the importance of securing the maximum possible benefit). It also factors in the nature and extent of your impairment.
